1. Acceptance of Terms
By accessing or using Deep Red ("the Service"), operated at deepredchess.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.
2. Description of Service
Deep Red is an AI-powered chess game review and coaching platform. The Service uses chess engines (Stockfish) and large language model APIs to generate analysis and commentary on chess games. The Service also provides interactive coaching, position analysis, and game import features.
AI-generated commentary is provided for educational and entertainment purposes. It may contain inaccuracies or errors. Deep Red does not guarantee the accuracy, completeness, or suitability of any analysis.
3. User Accounts
You may create an account using email and password or through third-party OAuth providers (Google, GitHub). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate information during registration and to keep your account information current. Deep Red reserves the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to:
- Use automated tools to scrape, crawl, or overload the Service
- Circumvent or attempt to circumvent rate limits or access controls
- Upload malicious content, viruses, or harmful code
- Resell, redistribute, or commercially exploit generated analysis without permission
- Impersonate another person or misrepresent your affiliation
- Use the Service for any unlawful purpose
5. API Keys and Usage
Free tier: Deep Red provides limited free access to AI analysis through a shared API key. This free tier is subject to rate limits that may change at any time without notice. Deep Red may modify, restrict, or discontinue the free tier at its sole discretion.
Bring Your Own Key (BYOK): You may provide your own API key from supported providers (Anthropic, OpenAI, Google). You are solely responsible for all costs, usage, and compliance with the respective provider's terms of service. Deep Red is not liable for any charges incurred on your API key.
API keys you provide are stored securely and used only to process your requests. Deep Red does not share, sell, or use your API keys for any other purpose.
6. Intellectual Property
The Deep Red service, including its design, code, branding, and features, is owned by Deep Red and its operators. All rights are reserved.
You retain ownership of chess games and PGN files you upload. By uploading content, you grant Deep Red a limited license to process it for the purpose of providing the Service.
AI-generated commentary and analysis are provided to you for personal use. Deep Red may use aggregated, anonymized usage data to improve the Service.
Deep Red uses Stockfish, an open-source chess engine licensed under the GNU General Public License.
7. Third-Party Services
The Service integrates with third-party providers including:
- AI providers: Anthropic (Claude), OpenAI, and Google (Gemini) for generating commentary
- Chess platforms: Chess.com and Lichess for game import
- Authentication: Google and GitHub for OAuth login
- Analytics: Google Analytics for usage tracking
Your use of these third-party services is subject to their respective terms and privacy policies. Deep Red is not responsible for the availability, accuracy, or policies of third-party services.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. DEEP RED DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Deep Red does not warrant that the Service will be uninterrupted, error-free, or secure, or that any analysis or commentary will be accurate or complete.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEEP RED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE.
Deep Red's total liability for any claim arising from the Service shall not exceed the amount you paid to Deep Red in the twelve (12) months preceding the claim, or $50, whichever is greater.
10. Service Modifications
Deep Red reserves the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. Deep Red will make reasonable efforts to provide advance notice of material changes.
11. Termination
You may delete your account at any time through your profile settings. Deep Red may terminate or suspend your account for violation of these Terms.
Upon termination, your right to use the Service ceases immediately. Deep Red may delete your account data within a reasonable period following termination.
12. Changes to These Terms
Deep Red may update these Terms from time to time. Material changes will be communicated through the Service or via email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
